The present General Conditions of contracting and use are intended to regulate the provision of information supplied in the mabaonline.com online store, as well as the commercial transactions that arise between mabaonline.com and the users of the domain www.mabaonline.com. Both browsing the online store and the purchase of any of the products offered therein, imply the acceptance as a user, without reservations of any kind, of each and every one of the present general conditions of contracting and use. mabaonline.com may modify the website to make as many changes and modifications as it deems appropriate and necessary for the proper functionality of the same, without prior notice.

Shipping costs to the Canary Islands, Ceuta, Melilla, Europe and third countries do not include customs costs if applicable, which will be paid at destination by the recipient of the goods.

10 . Order fulfillment.

The prices and offers presented on the website are valid only and exclusively for online orders placed on www.mabaonline.com, and may not coincide with the prices and offers in force in physical stores in Spain. All prices published on our website do not include value added tax (VAT). Validation of the order by the customer expressly implies knowledge and acceptance of these general contracting conditions as part of the conclusion of the contract. Unless proven otherwise, the data recorded by mabaonline.com constitutes proof of all transactions carried out between mabaonline.com and its customers. mabaonline.com will archive the electronic document in which the contract is formalised and it will be accessible. Once the purchase has been made and as soon as possible, the mabaonline.com Customer Service will send you a receipt of the purchase by email. If you do not agree with the data recorded in said confirmation, you may request that it be modified or the contract be cancelled.

Molibri Plan B, S.L. will issue a physical invoice; which, once the order has left our warehouses, can be downloaded from the “My orders” section of “My account”. Molibri Plan B, S.L. advises that it will not be able to subsequently modify sales invoices in compliance with current regulations. (Royal Decree 1619/2012 approving the Regulations governing billing obligations). The invoice will be issued in the name of the individual or company that placed the order, so the customer must ensure that the order is placed in the correct name. Subsequent changes will not be possible.

11 . Availability of products.

The selection of products offered on www.mabaonline.com is valid as long as the products are visible on the website, within the limits of available stock. As this is e-commerce, the stock is updated online, so it could happen that, occasionally, the stock runs out during the purchase process. Orders for items that are listed as having available stock and placed before 1:00 p.m. from Monday to Friday, on school days, will be shipped on the same day, or at most within the following 24 hours. If the order is placed on Friday or after the indicated time, it will be shipped on the following school day, or on Monday. Orders for items that are listed as having no available stock may request information on the expected replenishment date, using the form provided for this purpose. In addition to these availabilities, we must add the delivery times that the transport operators we work with may have. These times are calculated on working days - Monday to Friday - since mabaonline.com does not ship on holidays, Saturdays or Sundays. The shipping times indicated are indicative. In the event of a stock shortage or temporary unavailability of an item, mabaonline.com will contact you to inform you and give you a new delivery time or, if it is not possible to serve you said product, proceed to cancel it. In any case, a delay in delivery with respect to the indicated times will not entitle the customer to demand any compensation.

12 . Payment methods and shipping times.

Home delivery Express Service 24/48 hr. The products are sent to the shipping address that you have indicated in the order. In the case of placing an order for several items with different availability, the delivery time will take into account the longest expected delivery. In exceptional cases, mabaonline.com reserves the right to split the order, sending the available items and leaving the unavailable items pending a second shipment. In this case, the second shipment is made at no additional cost. We offer you the shipping method that we have arranged to deliver your order in the most comfortable, fast and economical way. If you wish your shipment to be sent by another service, you must notify us by email before placing your order and we will inform you of the additional price that you will have to pay, if applicable.

You also have the option of collecting your order at our warehouse at no cost. You only have to select this option at checkout and when your package is ready to be collected, we will send you an email to let you know.

Orders shipped from our warehouses from Monday to Friday will be delivered by courier to the address indicated on the following day or the second day after, before 7:00 p.m. for shipments to mainland Spain. For shipments to non-mainland Spain or destinations to other countries, transit times are different. Any delay in delivery with respect to the indicated deadlines will not entitle the customer to demand any compensation.

The courier does not make deliveries on Saturdays, Sundays or public holidays. In Ceuta, Melilla, the Canary Islands and non-EU countries, the delivery time is approximate as it depends on export and customs procedures. In the event that the customer detects any problem at the time of delivery of their order (damaged packaging, missing or damaged products) they must indicate this in writing on the carrier's delivery note, and contact our customer service center by phone at +34 916581464 within 24/48 hours of receipt. No return of damaged items will be accepted, as well as claims for missing items, if this has not been communicated within the established period. 13 . Payment.

Mabaonline.com offers you various payment methods so that you can choose the one that best suits you or best adapts to your needs:

Payment is made by credit card through the secure CECA platform of Ibercaja, the PayPal online platform or bank transfer to the Ibercaja current account.

In the event that the POS informs that the card has been denied, the order will be automatically cancelled, informing the customer online of the cancellation. For payments made with cards issued outside of Spain, it is necessary that the issuing bank is covered by the Secure Electronic Commerce Security Protocol (CES). Payments with cards that do not meet this requirement will not be accepted. mabaonline.com reserves the right to reject any transaction made with a credit card. In this case, we will proceed to refund the cash to the original card if the charge has been made.

For payments by bank transfer, it is very important that in the SENDER or ORDERER field you indicate the following: Order number - Your name and surname. You have a period of 7 working days to order the transfer after placing your order. The order will not be considered effective until we confirm the corresponding payment and therefore, delivery times begin to count from this date.

Cash on delivery: mabaonline.com does not accept payment by this method.

14. Right of withdrawal.

If you are not satisfied with the products purchased exclusively from mabaonline.com, you have the right to withdraw from the contract by returning your purchases, which must be returned to the following address:

In accordance with the provisions of the following paragraphs.

You may exercise the right of withdrawal within a period of 14 calendar days from the day on which you or a third party indicated by you, other than the carrier, received the material.

To exercise the right of withdrawal in respect of products purchased exclusively at www.mabaonline.com, you must express your unequivocal decision to withdraw from the contract in one of the following ways:

The item must be returned to our address in Madrid and you must first contact our Customer Service Department via email at info@mabaonline.com, clearly state your decision to withdraw from the contract and you will be sent a return authorisation.

If you exercise the right of withdrawal, we will refund all payments we have received from you, excluding delivery costs, without any undue delay and, in any case, no later than 14 calendar days from the date on which you inform us of your decision to withdraw from the contract. We will proceed to make said refund using the same payment method used for the purchase without you incurring any expenses as a result of the refund, except for the costs of returning the product. In all cases, the products to be returned must be in perfect condition, in their original packaging and with all components included. If this is not the case, the right of withdrawal cannot be exercised.

The purchase of products that have been ordered from mabaonline.com “expressly” cannot be withdrawn from, nor in other legally excepted cases. The right of withdrawal regulated in this section will only be applicable to products purchased solely and exclusively through www.mabaonline.com, so in no case will it be applicable to custom-made products manufactured to order.

15 . Return of products.

This right is additional to the rights recognised in the Revised Text of Law 1/2007 of 16 November on the defence of consumers and users, amended by Law 3/2014 of 27 March. In these cases of return, the period to make the return will be 7 calendar days from the purchase or receipt of the product, and you can choose to have the money paid, the product, or the product replaced with an identical one in perfect condition.

If the product to be returned is no longer in stock, or it is not possible to replace it because it is no longer manufactured, the option will be to directly return the money paid. Except for the costs incurred in shipping or return. In this case, the customer will not be entitled to demand any compensation.

The circumstances that may lead to a return are the following:

a) Product defective due to transport: If at the time of collection or delivery of the product you detect any damage to the packaging or product, you must indicate this on the carrier's delivery note and contact us within 24/48 hours to report the incident. RETURNS WILL NOT BE ACCEPTED if the product has been personalized, engraved or made to measure, only in the case of a defective product or incorrect shipment. In both cases, mabaonline must be informed within the first 48 hours after receiving the order.

MabaOnline reserves the right to reject returns communicated or sent outside the established period, or of products that are not in the same condition in which they were sent. If any of these instructions are not met, MabaOnline will not be responsible for any claim.

16. Product warranty.

All products sold by Molibri Plan B, S.L. have a 12-month warranty from the date of delivery of the product, although this does not include defects caused by negligence, knocks, incorrect use or improper handling, or materials that are worn out by use. The warranty only affects manufacturing defects and in no case misuse of the product. Mabaonline.com undertakes to repair or replace the defective product during the indicated warranty period. The shipping costs of the merchandise to mabaonline.com are the responsibility of the buyer. The merchandise will be returned repaired, if the repair is appropriate, with shipping costs paid by mabaonline.com

Molibri Plan B, S.L. will not accept claims from the end customer and will only serve the buyer indicated on the invoice.

For personalized products, it is at the discretion of mabaonline.com to replace them with new ones or pay the amount.

17. Image rights of products.

Upon formalizing the order, mabaonline.com will have, unless otherwise expressly indicated, the default authorization by the client to show the work carried out both on the website and physically.

The buyer is responsible for the use of corporate images in the marked logos.

Send an email to info@mabaonline.com if you DO NOT authorize the display of the work carried out for your company.

18. Refund of amounts paid.

The refund will be made through the payment method you used in the purchase. Mabaonline.com will not refund the amount or resend any merchandise until the receipt and condition of the packaging, product or item has been verified. The price to be refunded is the one originally listed in the order. Once the correct condition of the returned product has been verified, Mabaonline.com will proceed to refund the amount within a maximum period of 14 days. In the event of withdrawal, and regarding the costs of returning the products, mabaonline.com will act in accordance with the conditions established by law.

19 . Acceptance of the conditions of use.

The granting of an order means the acceptance of the conditions of use mentioned above.

The signing of these conditions implies the full acceptance of the same by the buyer and is of a general nature, being applicable to all purchases made by the purchasing company with MOLIBRI PLAN B, S.L. mabaonline.com from the date of signature.

In the event of any variation in these conditions, mabaonline.com undertakes to contact the client and send them the new ones for their reading and approval.

Delivery times are understood in working days and may be affected by the work calendar of both the country of origin and the destination country.
